{"id":1123,"date":"2011-08-05T09:17:55","date_gmt":"2011-08-05T13:17:55","guid":{"rendered":"https:\/\/www.m2sys.com\/blog\/?p=1123"},"modified":"2023-06-01T07:34:47","modified_gmt":"2023-06-01T11:34:47","slug":"do-employees-have-a-right-to-refuse-enrollment-in-a-biometric-system","status":"publish","type":"post","link":"https:\/\/www.m2sys.com\/blog\/others\/do-employees-have-a-right-to-refuse-enrollment-in-a-biometric-system\/","title":{"rendered":"Do Employees Have a Right to Refuse Enrollment in a #Biometric System?"},"content":{"rendered":"<p><a href=\"https:\/\/www.m2sys.com\/rightpunch-biometric-time-clock\/?utm_source=Article-Enrollment&amp;utm_medium=RightPunch-2&amp;utm_campaign=Blog-DisplayAds\" target=\"_blank\" rel=\"noopener noreferrer\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft wp-image-3779 size-medium\" title=\"Biometric Time Clock\" src=\"https:\/\/www.m2sys.com\/blog\/wp-content\/uploads\/2011\/08\/time-clock-300x251.png\" alt=\"biometric time clock\" width=\"300\" height=\"251\" srcset=\"https:\/\/www.m2sys.com\/blog\/wp-content\/uploads\/2011\/08\/time-clock-300x251.png 300w, https:\/\/www.m2sys.com\/blog\/wp-content\/uploads\/2011\/08\/time-clock.png 304w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a><strong><span style=\"text-decoration: underline;\">Biometrics is a Growing Identification Technology\u00a0<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\">It\u2019s no secret that biometric technology deployments are on the rise.\u00a0 Increasingly, retailers are catching on to the unique benefits and security that biometric technology offers to positively identify an individual by their physiological characteristics instead of through ID cards, personal identification numbers or passwords.\u00a0 The <a href=\"https:\/\/www.m2sys.com\/blog\/biometric-hardware\/top-5-uses-biometrics-across-globe\/?utm_source=blog&amp;utm_medium=blog%20post&amp;utm_campaign=top%205%20uses%20globe\">rapid growth of biometric technology<\/a> seemed to begin shortly after we shifted into a society aggressively focused on safety and security in the wake of the rise in global terrorism.\u00a0 Biometrics was soon recognized as the only technology that could tell with near absolute certainty that someone was who they claimed to be.\u00a0 Governments were the first to actively use <strong><a href=\"https:\/\/www.m2sys.com\/blog\/biometric-hardware\/eliminating-ghost-workers-biometric-identification-management\/?utm_source=blog&amp;utm_medium=blog%20post&amp;utm_campaign=ghost%20identification%20management\">biometric identification<\/a><\/strong> to secure their intellectual and physical property and then slowly expanded to <a href=\"https:\/\/www.m2sys.com\/automated-fingerprint-identification-system-afis-border-control-and-border-protection\/?utm_source=blog&amp;utm_medium=m2sys&amp;utm_campaign=border%20control\">border control<\/a> and public safety.<\/p>\n<figure id=\"attachment_1125\" aria-describedby=\"caption-attachment-1125\" style=\"width: 300px\" class=\"wp-caption alignright\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-1125 size-medium\" title=\"federal courthouse\" src=\"https:\/\/www.m2sys.com\/blog\/wp-content\/uploads\/2011\/08\/federal-courthouse1-300x225.jpg\" alt=\"employee's rights to enroll in a biometric identification system\" width=\"300\" height=\"225\" srcset=\"https:\/\/www.m2sys.com\/blog\/wp-content\/uploads\/2011\/08\/federal-courthouse1-300x225.jpg 300w, https:\/\/www.m2sys.com\/blog\/wp-content\/uploads\/2011\/08\/federal-courthouse1.jpg 500w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><figcaption id=\"caption-attachment-1125\" class=\"wp-caption-text\">Federal Courthouse<\/figcaption><\/figure>\n<p style=\"text-align: justify;\">The progression of biometric technology didn\u2019t stop solely with security deployments though; it kept on growing and progressing.\u00a0 As price points dropped and the technology became more refined, deployments began to shift to the private sector as companies took notice that biometrics had strong potential to help them with problems like <strong><a href=\"https:\/\/www.m2sys.com\/blog\/workforce-management\/stop-employee-time-theft-and-embezzlement-with-automated-time-and-attendance\/?utm_source=increase%20employee%20productivity&amp;utm_medium=blog%20post&amp;utm_campaign=blog\">employee time theft<\/a><\/strong>, inventory shrink, identity theft, compliance and fraud.\u00a0 Widespread adoption by the private sector fueled the growth of biometric systems designed to positively identify individuals to prevent these problems and with this growth came increased scrutiny of the technology (specifically how individual biometric data was stored and what it may be used for other than identification) by Privacy advocates and proponents of civil liberty protection.\u00a0 Their feelings are that <strong><a href=\"https:\/\/www.m2sys.com\/blog\/guest-blog-posts\/future-ecommerce-strategy\/?utm_source=blog&amp;utm_medium=guest%20blog%20post&amp;utm_campaign=biometrics%20for%20ecommerce\">biometric technology<\/a><\/strong> violates individual privacy without a 100% guarantee that templates are safely stored and unable to be stolen and governments are not using the data to track citizens interacting with a system and subsequently disseminating the information collected to external bodies.<\/p>\n<p><iframe loading=\"lazy\" title=\"RightPunch\u2122 - The PC &amp; encrypted-media; gyroscope; picture-in-picture\" allowfullscreen><\/iframe><\/p>\n<div align=\"center\"><small style=\"font-size: 12px; font-style: italic; text-align: center;\">Affordable Biometric Time Clock Software<\/small><\/div>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">These arguments are strong but perhaps a closer look at how the technology works would help uncover some answers to these concerns and clear up some misconceptions about biometric technology.<\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"text-decoration: underline;\">The Privacy Issue \u2013 How Does Biometric Technology Actually Work?<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\">Most people believe that when an individual places their finger on a <strong><a href=\"https:\/\/www.m2sys.com\/automated-fingerprint-identification-system-afis\/?utm_source=blog&amp;utm_medium=m2sys&amp;utm_campaign=afis\">fingerprint reader<\/a><\/strong> to register their identity in a biometric system, an image of their fingerprint(s) is stored somewhere on a server or a computer.\u00a0 In actuality this is typically not the case.\u00a0 Instead, the biometric matching software extracts and stores what is known as an identity template.\u00a0 This is a mathematical representation of data points that a biometric algorithm extracts from the scanned\u00a0fingerprint. The biometric identity template is simply a binary data file, a series of zeros and ones. \u00a0The algorithm then uses the template to positively identify an individual during subsequent fingerprint scans.\u00a0 No image is ever stored or transmitted across a network.\u00a0 In addition, the algorithm is \u201cone way\u201d which means that it is nearly impossible to recreate the original biometric image from the template.\u00a0 In other words, it is nearly impossible to reverse engineer the data that is sent to positively identify an individual and successfully \u201csteal\u201d their biometric identity.<\/p>\n<p style=\"text-align: justify;\">Understanding these processes is central to realizing how the danger of identity theft or a <strong><a href=\"https:\/\/www.m2sys.com\/blog\/biometric-hardware\/do-mobile-biometrics-need-more-security\/?utm_source=http%3A%2F%2Fblog.m2sys.com%2Fbiometric-hardware%2Fdo-mobile-biometrics-need-more-security%2F&amp;utm_medium=blog&amp;utm_term=guest%20blog%20post%20&amp;utm_campaign=mobile%20biometrics%20security\">security breach<\/a><\/strong> is significantly lessened, if not completely eliminated, through the use of a proprietary algorithm with no stored image and data encryption. Biometric templates are also not linked to anything in a closed system that can positively identify an individual outside of that system.<\/p>\n<p style=\"text-align: justify;\">However, privacy advocates strongly feel that the idea of capture, storage and use of <strong><a href=\"https:\/\/www.m2sys.com\/blog\/biometric-hardware\/biometrics-data-security\/?utm_source=blog&amp;utm_medium=blog%20post&amp;utm_campaign=privacy%20in%202015\">biometric data<\/a><\/strong> (specifically by governments either through mandated deployments for social services\/social issues or request of data and records from private business) to assemble a comprehensive citizen knowledge base and thus exercise covert control of society in general is a violation of individual privacy and proves to be a valid point.<\/p>\n<figure id=\"attachment_7441\" aria-describedby=\"caption-attachment-7441\" style=\"width: 300px\" class=\"wp-caption alignleft\"><a href=\"https:\/\/www.m2sys.com\/cloudapper-modularized-framework-enterprise-cloud-application\/?utm_source=Employees%20Right%20to%20Refuse&amp;utm_medium=CloudABIS&amp;utm_campaign=Blog-DisplayAds\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-7441\" src=\"https:\/\/www.m2sys.com\/blog\/wp-content\/uploads\/2014\/04\/CloudABIS-2.png\" alt=\"CloudABIS\" width=\"300\" height=\"250\" \/><\/a><figcaption id=\"caption-attachment-7441\" class=\"wp-caption-text\">CloudABIS<\/figcaption><\/figure>\n<p style=\"text-align: justify;\"><strong><span style=\"text-decoration: underline;\">Can an Employee Claim that using Biometric Technology is a Violation of Their Privacy?<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\">If you adopt biometric technology for <strong><a href=\"https:\/\/www.m2sys.com\/blog\/workforce-management\/the-rise-of-biometric-time-and-attendance-in-workforce-management\/?utm_source=blog&amp;utm_medium=blog%20post&amp;utm_campaign=rise%20of%20biometric\">time and attendance<\/a><\/strong>, access control or another deployment within a business, do employees have a right to refuse participation on the grounds that it violates their privacy and\/or individual civil liberties? It brings up an interesting question. Without irrefutable proof that a biometric database can\u2019t be hacked into and the templates reverse engineered into images, if an employee did decide to decline participation, would they be able to prove their claim that the technology did in fact violate their civil liberties?<\/p>\n<p style=\"text-align: justify;\">There have not been any known cases here in the U.S. of an employee taking their employer to court for their refusal to enroll in a biometric identification system that resulted in wrongful termination or a violation of their equal opportunity rights.\u00a0 However, shouldn\u2019t biometric information be treated as any other personally identifiable data that an employer keeps on file like social security numbers, pictures, or bank information if you request a direct deposit?\u00a0 Information that, if stolen, could be used to recreate you as a person?\u00a0 Most companies already have policies in place that govern the safe protection of this data and biometrics should arguably be included and not treated any differently.\u00a0 It should be treated the same way as the data you have already given up and is stored just by being an employee of the company.<\/p>\n<p style=\"text-align: justify;\">Most employers also monitor their employee\u2019s activities while they are at work which could include video, email and telephone monitoring. \u00a0An employee is then asked to sign that they received and read the employee manual that explicitly states their acknowledgement that they will be monitored throughout their employment tenure.\u00a0 Remember that this is not a request for permission to be monitored; it is an agreement that the employer will be doing it.<\/p>\n<p style=\"text-align: justify;\">It is also important to note if you have a Twitter or Facebook account, purchase on the Internet, use credit cards at brick and mortar establishments, subscribe to publications on the Internet, have any form of insurance or bank account, etc. you no longer have any privacy. If you use one or more credit cards, the credit card company knows where you eat, what you eat, what kind of car you drive, where you\u00a0live, what insurance you have, where you spend your vacations, what you read, how much you spend on shoes and more.\u00a0 If you use most social media platforms, you have publicly given up every bit of privacy you ever had.\u00a0 \u00a0\u00a0Although these are personal preferences, it makes the argument hard to justify that <strong><a href=\"https:\/\/www.m2sys.com\/blog\/biometric-hardware\/can-employees-refuse-enrollment-in-a-biometric-system\/?utm_source=blog&amp;utm_medium=blog%20post&amp;utm_campaign=refuse%20enrollment\">enrollment in a biometric system<\/a><\/strong> is any more egregious than most of the other daily online and offline activities that we participate in.<\/p>\n<span class='bctt-click-to-tweet'><span
